TEACHSITTER LLC – TERMS OF SERVICE

Please read these Terms of Service (“Terms”) carefully. They govern your access to and use of the TeachSitter website, mobile application, and any related services (collectively, the “Platform”). These Terms incorporate our Privacy Policy by reference. By using the Platform, you agree to both documents.

  1. Acceptance of Terms
By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
  2. Nature of the Platform – Neutral Marketplace ONLY
TeachSitter is a neutral online marketplace that only facilitates introductions between families (“End Users”) and independent tutors, babysitters, and coaches (“Providers”).
• TeachSitter is NOT an employer, agency, contractor, or service provider.
• Providers are independent contractors — never employees or agents of TeachSitter.
• TeachSitter does not hire, train, supervise, direct, or control Providers or the services they perform.
• All services are performed under direct contracts between End Users and Providers.
• The Platform is provided “as is” and “as available” with no warranties of any kind.
  3. Eligibility
You must be 18+ and legally able to enter binding contracts. Providers must have unrestricted work authorization in the jurisdiction where services are performed.
  4. Background Checks (Limited Disclaimer)
TeachSitter may facilitate limited background checks, but makes no guarantees as to accuracy or completeness. End Users remain solely responsible for vetting Providers.
  5. Body-Worn Cameras and Recording Policy (MAXIMUM LIABILITY PROTECTION)
5.1 Ownership and Loan of Equipment – NO ENDORSEMENT
Body-worn cameras offered through the Platform (“Camera(s)”) are the sole property of TeachSitter LLC and are provided to approved Providers on a temporary, no-cost (or refundable-deposit) loan basis solely as a convenience.
TeachSitter does not manufacture, endorse, warrant, or guarantee the quality, safety, legality, reliability, recording performance, or fitness for any particular purpose of the loaned Camera. The Camera is provided strictly “AS-IS” with all faults and without any express or implied warranty of any kind.
5.2 Provider’s and Parent’s Exclusive Responsibility for Functionality and Connectivity
The Provider (and any End User/parent who takes possession of a Camera) is solely responsible for charging, powering on, connecting to Wi-Fi/cellular, paying for data plans, monitoring recording status, and ensuring the Camera functions throughout the session.
TeachSitter has no duty to test, repair, replace, or guarantee performance or connectivity and is not liable for failed or missing recordings.
5.3 Mandatory Return of Inactive Cameras
If a loaned Camera is not used for any paid session for four (4) consecutive weeks, the Provider must return it (with all accessories) within seven (7) days of notice or be charged the full replacement cost (currently $299) plus late fees.
5.4 Recording Consent
By booking, accepting, attending, or permitting a session in which any body camera (TeachSitter-loaned or personal) is used, End Users and parents/guardians of minors irrevocably consent to audio and video recording of the entire session.
5.5 Use and Ownership of Recordings
All recordings are the sole property of the Provider or parent who activated or possessed the recording device. TeachSitter does not access, store, or control recordings unless voluntarily uploaded for dispute resolution (and then only temporarily).
5.6 Complete Release of TeachSitter
You release TeachSitter from any liability related to the Camera or recordings, including but not limited to malfunction, failed recordings, lack of connectivity, privacy claims, consent violations, loss/theft/damage of equipment, or any use/misuse of recordings — even if based on alleged negligence.
5.7 Two-Party Consent Jurisdictions
The person activating any recording is solely responsible for obtaining and documenting all required consents.
5.8 Use of Personal or Third-Party Cameras Permitted – FULL USER RESPONSIBILITY
Providers and End Users may, at their sole discretion and expense, use their own body-worn or other recording devices instead of or in addition to any TeachSitter-loaned Camera.
When a personal or third-party camera is used, the Provider or End User assumes 100% of the responsibility for the device’s legality, functionality, connectivity, data storage, consent compliance, and all privacy or other claims arising from its use. TeachSitter has no liability whatsoever for personally owned recording equipment.
  6. Direct Contract Between End User and Provider
Bookings create a direct contract between End User and Provider only. TeachSitter is not a party and has no liability.
  7. Payments
Processed exclusively by third-party payment processors. TeachSitter only receives its platform fee.
  8. Release and Limitation of Liability
YOU RELEASE TEACHSITTER FROM ALL LIABILITY arising from use of the Platform, services, Cameras, or recordings.
Maximum liability is limited to the greater of (i) fees you paid TeachSitter in the prior 12 months or (ii) $500. No consequential, indirect, or punitive damages under any circumstances.
  9. Indemnification
You will defend and indemnify TeachSitter against any claims arising from your use of the Platform, services, Cameras, recordings, or violation of these Terms.
  10. Dispute Resolution – Mandatory Arbitration
All disputes will be resolved by binding individual arbitration in Dallas County, Texas under AAA rules. NO CLASS ACTIONS. NO JURY TRIAL. Texas law governs.
  11. Termination
TeachSitter may suspend or terminate your account at any time without liability.
  12. Changes to Terms
Continued use after changes constitutes acceptance.
